Night time fishing of redds: its real

Remember the Dec 22 post I made about night fishing? Last night two individuals were caught fishing redds by local LEOs called to the scene by one of our members. They had spinning gear with heavy lures and hooks. Its uncertain that they had caught fish before being ordered off the creek. Presumably they were cited.

Our member doesn't visit the forum often and was unaware of my original post. He drives H128 fairly regularly at night and often sees cars parked at the bridge and other spots along the road.

DFG enforcement has been notified; please be vigilant when you pass through the area -these guys were visible from the road.

That's pretty dirty.  Those big fish taste like garbage anyways with all the toxins built up in their bodies.  Sucks that the flows are so low you can actually do that at night with not much more than a headlamp.  Right after the reg change I was fishing around access 2 and these dudes pull up in a blue mini van behind where I was parked.  They were creepin slow and I thought they were going to mess with me.  Dude pulls up next to my truck and says "Hey man check this out".....Pulls a gutted 20" female from his lap and shows it to me and they both start laughing.  They tore off immediately and were both pretty smashed as well.  I didn't get their plate but I did call them in.  Drunken driving and poaching.  nono

No that really is weak night fishin for our trout.  It's bad enough with the hacks during the day.

I think we can all agree that this is downright disgusting, however, I am not sure exactly what regulations are being broken here.  I can imagine that fishing at night is illegal and if these guys were using barbed hooks, that would be illegal.  Also, it would be a violation if they kept any fish.

Steve, my attorney wife is useless in this case so please let me know.

Thanks to the guy who alerted the sheriffs to these morons.

As for time of day, that depends on the county/area I think. I know that in Bishop, Ca, we were only allowed to fish for trout from 30 minutes before sunrise and 30 minutes after. However catfishing in the middle of the night was okay. The catfish we fished for were in different bodies of water than the trout. For this area however, I'm not sure what the regs are for the permitted times of day.

People do night fish for trout, so that's not out of the question.

As for breaking regs, there's 3 potentials that I see... 1) I would think the lures they had were multi-hooked or at least had treble hooks on them. 2) Night fishing this area could be illegal. 3) Wouldn't be able to say they were snagging fish unless you caught them in the act.

Fishing for trout on PC at night is illegal. Fishing with barbed hooks is illegal; more than 3 hooks is illegal. Foul hooking is illegal, keeping any fish is illegal, spotlighting to take a fish is illegal. Since the LEO was a Yolo County Deputy, they may have gotten off with a warning or cited for fishing at night. The local warden was notified of the illegal fishing. He has been on the creek pretty often, hopefully he can do nightime drivebys.
