From a quick glance, Lower Putah Creek extendeing from below the Lake Solano diversion dam all the way to the sink hole in the marsh seems to falls under Article 2: District General Regulations for the Valley District (all Solano and Yolo County):
(3) All strems except anadromous waters and those listed by name in the Special Regulations.
This actually confuses the issue of whether or not Lower Putah remains open to fishing or not:
Putah Creek (Monticello to Lake Solano) is listed as open zero limit barbless, as we all know. However this puts Lower Putah (and even Lake Soloano given the wording) in questions as to the legality. Certainly Lake Solano is "non-anadromnous" by vitrue of the diversion dam, but the CalSport Org change justification seems to inlcude Lake Solano in the zero limit, artificial, barbless section though everywhere I have read and asked has said that the restrictions only apply upstream of the fla****er portion of Lake Solano roughly defined as the island split where water is clearly flowing.
So I am now confused about bait fishing at Lake Solano, which I see people doing all the time literally every day, and now we move to Lower Putah Creek.
Below the Lake Solano diversion dam is the water considered anadromous? I am not sure. It is not naturally connected to a passage for salt water fish, though during high flows we know the possibility of salmon migration exists. This makes Lower Putah not listed by name in the special regulation, and therefall falling under (3) and open all year but the stretch is also recognized as potentially anadromous which would mean it is not open beyond general season.
SO!!! Can anyone answer a few simple questions:
1) Lake Solano from the Diversion Dam to the Island Split: In or out of scope for the artifical, barbless, zero limit restrictions?
2) If not under the restriction, what regulation and season applies to Lake Solano?
3) Lower Putah Creek from the Lake Solanao Diversion Dam downstream to the sink hole / by-pass is or is not considered anadromous?
4) Lower Putah Creek from the Lake Solanao Diversion Dam downstream is or is not open year round?
5) Can I fly fish Lower Putah year round for bass/sacramento pikeminnow?
I would love it if when people answered they could provide a reference or small justification for why they feel that way rather than just one liners.
This is a clear example of where the regulations make doing the right thing about damn impossible becuase for certain stretches they are too hard to definitively say if it is legal to fish there or not during certain times of the year.
Bonk, regarding lower Putah, I was told by a DFG officer, that technically, one should have his/her steelhead card with them and filled out because it is considered anadromous.

Answer: Reg states ambiguously that LS is included in the barbless, etc., reg. DFG is interpreting it to exclude LS, which was in the original draft wording, while allowing year around bait fishing below the island.

3) Lower Putah Creek from the Lake Solanao Diversion Dam downstream to the sink hole / by-pass is or is not considered anadromous?
Answer: It is anadromous-it's the reason there's water in the lower Creek year around.
4) Lower Putah Creek from the Lake Solanao Diversion Dam downstream is or is not open year round?
Answer: haven't found a definitive answer on this one. I can't find a special regulation, so assume it is closed to trout fishing, following the regular season dates.
5) Can I fly fish Lower Putah year round for bass/sacramento pikeminnow?
Answer: like 4) above the best way to get an answer is to contact the Enforcement Division of DFG

See pages 28 and 29. Waters not listed in special regs. Putah below the diversion dam is unlisted and anadramous so zero take of trout , steelhead and salmon. Open year around for fishing.
Lake Solano is not listed so 5 fish limit open year around.
That is my interpretation of the regs, but DFG may have another interpretation.
Thanks for all the info guys! I am looking forward to getting back on the creek belwo the dam as I have been not going due to unknown regulation status. Looking forward to seeing the differences in Winter versus Summer on the lower portion.
